1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No.21/2010 registered at Police Station Dhamdha, District Durg (C.G) for the offences punishable u/ss 2(f), 4, 6, 10, 11 of the Chhattisgarh Cattle Protection Act 2004 and Section 66/192 of the Motor Vehicles Act.

2. As per the prosecution case, on 08.02.2010 while the applicant was taking the cattle to the slaughter house , he was arrested.

3. Learned counsel for the applicant would submit that the applicant was a daily wager; he is lodged in jail since 02.08.2017 and he has never absconded, therefore, he may be enlarged on bail.

4. On the other hand, learned State Counsel opposes the bail application.

5. A perusal of the order sheet would show that the applicant was enlarged on bail, he absconded from 2010 and thereafter he was arrested on 02.08.2017.

6. Considering the fact that earlier the applicant was enlarged on bail and he has absconded for a long time, I am not inclined to release him on bail. Accordingly, the bail application is rejected.
