Hon'ble Shri Justice Goutam Bhaduri Order On Board 16.09.2019 Heard.

1. Grievance of the petitioner is that an application has been filed under sub section 3 of Section 80 of the Motor Vehicles Act, 1988 for change of condition of permit. Said application was made on 13/02/2019, however same is not being decided by the RTO.

2. Learned State counsel submits that there is no provision of change of time.

3. Considering the fact, without any observation on the merits, it is directed that respondent No.2 Regional Transport Authority shall decide the application of the petitioner filed under sub section 3 of Section 80 of the Motor Vehicles Act, 1988 on its own merit within a further period of 60 days.
