The present MCC has been filed seeking modification of the order dated 22.09.2021 whereby this court had directed the respondents-State to consider the case of the petitioners for promotion to the post of Training Officer in accordance with rules applicable.

The apprehension and the reason for filing of present MCC is that the rules quoted in the writ petition was subsequently amended and the amended rules have not been disclosed by the petitioners at the time of disposal of the writ petition and is also not mentioned in the writ petition. Be that as it may, the operative part of the order passed by this court very specifically states that the promotion to be made has to be in accordance with applicable rules which in other word means that the rules which are applicable on the date when the exercise of promotion is carried out.

Given the said facts, this court is of the opinion that the order passed by this court on 22.09.2021 does not warrant any interference or modification as such at this stage.

Accordingly, the MCC stands disposed of.
