1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.50/2017 registered at Police Station Rakhi, District Raipur for offence under Sections 376 and 366 of the IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012.
2. The applicant has allegedly abducted and committed forcible sexual intercourse with the prosecutrix aged less than 18 years.
3. In her statement under Section 164 CrPC, the prosecutrix has stated that her physical relations with the applicant was consensual and that they had in-fact married on 11.4.2017. When examined in the Court she has not supported the
prosecution on any count.
4. Considering the quality of evidence, this Court is inclined to release the applicant on bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
