The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.398/2016 registered in Police Station City Kotwali, Distt. Mungeli (CG) for offence punishable under section 436 read with Section 34 of IPC.

As per the prosecution case, on 19/08/2016 the applicant alongwith one Amit had set on fire the betel shop of Dharmesh Pandey and has caused loss of Rs.20,000-30,000/-. Initially suspicion was raised against Pokhraj and after investigation the applicant was arrested and on his memorandum, one motorcycle was recovered.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case only on the basis of memorandum and on 19/08/2016 the incident happened but the alleged recovery was after two months and FIR do not contain the name of the applicant and on that basis the other co-accused have been enlarged on bail by the trial court, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the documents. It also contains the statement of Manoj Kashyap wherein extra judicial confession has been made. Considering such statement, this court is not inclined to release the applicant on bail.
