The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.32/2016 registered in Police Station Khadgawan, District-Koriya (CG) for offence punishable under section 420/34 of Indian Penal Code.

As per the prosecution case, in between 9/02/2016 to 11/02/2016 the applicant alongwith other co-accused at village Chirmi were vaccinating for Hepatitis-B and were charging Rs.50/- from the villagers without permission of the Health Department.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case. He submits that other co-accused has been enlarged on bail by this court on 17/08/2016 vide M.Cr.C. No.4498/2016 and the injection which was administered was not fake and permission was obtained from the District Medical Officer, charge sheet has been filed, no further investigation is necessary, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary. Charge sheet in this case has been filed.

Considering the facts and circumstances of the case and also for the fact that the applicant is in jail since 21/10/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
