1. The applicant has been arrested in connection with Crime No.23 of 2017 registered in Police Station- Rajpur, District- Balrampur (C.G.) for alleged commission of offence under Section 20 (B) (ii) (C) of the NDPS Act.
2. Case of the prosecution, in brief, is that the applicant was found in the vehicle in which 73 k.g. ganja was being transported.
3. In the application the ground taken is that the applicant is a minor and that he has been falsely implicated. He has not committed any such offence and the ganja does not belong to him.
4. Learned State counsel would submit that as per the case diary records, the applicant was found present in the vehicle which met with an accident and 73 kg. of ganja was found in the vehicle. He would further submit that there is no material in the case diary to show that the applicant is a juvenile.
-25. Having considering the submission, perusing the case diary, I am not inclined to grant bail to the applicant.
6. The application is accordingly rejected.
