ORDER

02.11.2020 Heard

1. Learned counsel for the petitioners would submit that the petitioners were appointed as Trade Constables in the 13th Battalion of Chhattisgarh Armed Forces, Bango, District Korba. It is stated that the similarly placed Trade Constables who were appointed in the 17th and 18th Battalion are being paid pay scale at the pay band of Rs.5200 - 20200/- with grade pay of Rs.1900/-, whereas the petitioners are being paid pay scale of Rs.6410/- (basic) with grade pay of Rs.1300/-, therefore, discrepancy exists there in payment of Trade Constables who are discharging similar job.

2. Perused the documents. Prima facie, it shows that as per Annexure P/4, the Trade Constables who were appointed in the 17th and 18th Battalion, are being paid higher pay scale and grade pay, whereas the petitioners, who were appointed in the13th Battalion, are being paid less salary, therefore, the case of the petitioners needs to be considered.

3. Under these circumstances, the petitioners shall be at liberty to make a representation to the respondent No.2 within a period of three weeks, ventilating all their grievances and shall also file all the necessary required documents and on such representation being filed, the respondent No.2 shall consider and decide the same within a further period of four months from the date of receipt of copy of the representation.

4. With the aforesaid observation/direction, the writ petition stands finally disposed of.
