The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No.641/2016 registered in Police Station Sarkanda, Civil and Revenue District Bilaspur (CG) for offence punishable under section 302, 34 of Indian Penal Code. 2.
As per the prosecution case, for grazing of the field by the cattles the applicant alongwith other family members have assaulted Mina Bai, as a result of that she sustained internal injury and eventually died on 20/07/2016. The incident of assault happened on 4/07/2016. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and infact deceased Mina Bai sustained injury while she fell down from the motorcycle while going to hospital and she initially was admitted to the hospital came back, she was cured, therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and statement of witness Saurangi Lal Suryavanshi and Santosh. Taking into such statement, without further
observation on the merits and also considering the fact that the applicant is a lady, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on her furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for her regular appearance before it as and when directed.
