Hon'ble Shri Justice Arvind Singh Chandel Order On Board 17/12/2021

1. The applicant has filed this second bail application for grant of anticipatory bail under Section 438 of the Cr.P.C. as he is apprehending his arrest in connection with crime no. 70/2020, registered at Police Station Mahasamund(C.G.) for the offence punishable under Sections 409, 448 & 120-B/34 of the IPC and Section 49 (A) of the Chhattisgarh Excise Act.

2. First bail of the applicant was dismissed as withdrawn vide order dated 29.06.2020 passed in MCRCA No. 534/2020 with a direction that applicant may preferred an application under Section 439 of Cr.P.C. for grant of regular bail before the Trial Court and it was also directed that the Trial Court will decide the same in accordance with law on the same date of its filing.

3. It has been informed that charge-sheet of the case has been filed on 30.09.2021 declaring the Applicant absconded.

4. I do not found any new ground to entertain the instant bail application. Accordingly, the same is dismissed at motion stage itself.

5. In compliance of order dated 10.12.2021, Mr. Vinod Sharma, Sub-Inspector, Police Station Mahasamund, Distt. Mahasamund is present today. His presence is marked.
