1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 122/2016 registered at P.S. Dongargaon, Distt. Rajnandgaon (C.G) for the offence punishable under Section 20-B of the Narcotic Drug and Psychotropic Substances Act.

2. As per the prosecution case, on 25.06.2016 an information was received that the applicant was carrying cannabis in motorcycle bearing No. C.G.08-J/1657 and on such information when the vehicle was intercepted, from the possession of the applicants 6.650 Kgs., of Ganja was recovered.

3. Learned counsel for the applicants would submit that the applicants have been falsely implicated and the cannabis was not seized in person from the applicants, therefore, they may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail.

5. Perused the case diary and seizure documents.

6. Considering the recovery so made from the applicants and looking to the quantity of Ganja, I am not inclined to allow this bail application. Accordingly, it is rejected. Sd/- GOUTAM BHADURI JUDGE R a o
