This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.65/2016 registered at Police Station- Anda, District Durg (C.G.) for the offence punishable under Section 363, 366(A) & 370 of Indian Penal Code and 3, 4 of the Protection of Children from Sexual Offences Act, 2012. The first bail application was dismissed on 17.08.2016 in MCRC No. 4654 of 2016 on merits. 2.
Learned counsel for the applicant would submit that all the charges have been framed and no charge have been framed under the POCSO Act, therefore, the instant bail application may be considered.

Learned State counsel opposes the prayer for grant of bail.

Perused the earlier order dated 17.08.2016 wherein the bail application was rejected on merits. Taking into such facts only because of the charge have not been framed under the POCSO Act, no change of circumstances apparently appears to exists to reconsider the second bail application.

Accordingly, the bail application is dismissed at the admission stage itself.
