The grievance of the petitioner in the instant Writ Petition is nonconsideration of his case for promotion. 2.

The only ground which perhaps appear of the respondents in not granting promotion to the petitioner was the pendency of a departmental enquiry.

The petitioner in the instant Writ Petitition have categorically pleaded that an identically placed person namely Rajpati Pandey has already been granted promotion in spite of the fact that the said employee also is facing a departmental enquiry for the same changes as that of the petitioner. 4.

In the given facts, particularly the promotion which has been granted to one Rajpati Pandey, let the respondent No.2 take a decision on the claim of the petitioner for promotion comparing his claim along with Rajpati Pandey and decide the pending representation Annexure-P/3 dated 04/09/2018 at the earliest preferably within 60 days from today. 5.
