Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 11/12/2017 Heard.

1. The applicant has been arrested in connection with Crime No.342 of 2016 registered at Police Station- Supela, District-Durg (C.G.) for the alleged commission of offence under Section 302, 120-B of IPC.

2. Case of the prosecution is that the applicant stabbed with knife on the victim who succumbed to death.

3. Learned counsel for the applicant would submit that the applicant is in jail for the last 1 1⁄2 years. It is submitted that if the case of the prosecution would only show that there was single stab injury which resulted in death, therefore, the applicant, in the background that the applicant was student and in a sudden quarrel, incident took place, conviction may not travel beyond 304 Part-II of IPC. Therefore, at this stage, the applicant may be granted bail because the victim has already been examined.

4. On the other hand, learned State counsel opposes the prayer.

5. Taking into consideration the submission of learned counsel for the parties, nature and gravity of allegation and the material against him, I am not inclined to grant bail to the applicant. Therefore, the bail application is rejected.
