The applicants have preferred these applications filed under Section 439 of the Cr.P.C. for grant of regular bail as they are arrested in connection with crime No.317/2017 registered in Police Station Saja (Outpost Devkar), Dist. Bemetara for offence punishable under Section 354/34 of the Indian Penal Code and Section 12 of the Protection of Children from Sexual Offences Act, 2012.

The applicants allegedly committed flirt with the prosecutrix and demanded a kiss from her.

Learned counsel appearing for the State would oppose the bail application. 5.
Considering the facts and circumstances of the case; particularly considering the nature of allegation; investigation has already been completed and the charge sheet has been filed; and also considering the fact that the applicants are in detention since 26-8-2017, this Court is inclined to release the applicants on bail. Accordingly, both the applications are allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
