Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 12/12/2017

1. The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No.21/2017 registered at Police Station Golebazar, Raipur District Raipur for offence under Sections 420, 468 and 471 of the IPC.

2. The applicant has allegedly applied for appointment on the post of Assistant Teacher (Lib). During scrutiny, certificate of B. Lib. qualification was sent for verification to the concerned University on which it was disclosed that the certificate is forged. The concerned authority thereafter lodged report against the applicant. The applicant's first bail application was rejected on merits on 17.5.2017 in MCRC No.1934/2017.

3. True it is that the applicant's first application was rejected on

merits, however, some other accused persons facing almost identical charges on the FIR lodged in the same Police Station have been released on bail by this Court in MCRC No.1529/2017. 4 other similarly placed accused persons have been released on anticipatory bail in MCRCA Nos.323, 324, 339 and 350 of 2017.

4. Therefore, considering the fact that the applicant is a lady aged about 29 years and is in confinement since 10.2.2017 and the offences are triable by the Judicial Magistrate 1st Class, this Court is inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on her executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court. She is directed to appear before the trial Court on each and every date given by the said Court.
