The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.235/2016 registered in Police Station Kanker, Distt. North Bastar Kanker (CG) for offence punishable under sections 420, 467, 468, 471 & 120-B of Indian Penal Code. 2.
As per the prosecution case, in the year 2010, a loan was obtained by Dasru and Kunwar Singh Netam but co-accused Mahesh Shori personified himself as Kunwar Singh Netam and whose loan application was filled up by the present applicant and on that basis the agricultural loan was obtained. Subsequently, when the loan was not repaid the recall notice was issued to to Kunwar Singh Netam and this fact came to the fore.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case. He submits that actually the applicant is an illiterate person and the loan was obtained by Dasru who is brother of Kunwar Singh Netam. It is also submitted that similarly placed coaccused Mahesh Sori has been enlarged on bail by this Court in
M.Cr.C.No. 7016/ 2016 on 09.112016. He further submits that the charge sheet in this case has been filed; no further investigation is necessary and the applicant is in jail since 06.08.2016, therefore, he may be enlarged on bail.

Learned State counsel opposes the prayer for grant of bail. However, he do not dispute the fact that the person against whom similarly allegations have were levelled has been enlarged on bail by this Court in M.Cr.C.No.7016 of 2016 5.
Considering the totality of the facts and circumstances of the case, especially the facts that similarly placed accused has been enlarged on bail by this Court in M.Cr.C. 7016/2016; charge sheet has been filed, offences are triable by JMFC and the applicant is in jail since 06.08.2016 and looking to the nature of evidence available against this applicant, this court is inclined to allow this bail application. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
