The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.173/2017 registered in Police Station Khairagarh, District Rajnandgaon (C.G.) for offence punishable under sections 354, 354 A(1)(ii), 354 B of IPC and Section 8 of POCSO Act.

Case of the prosecution, in brief, is that on 11/06/2017 while the prosecutrix was returning from her field, at that time applicant caught hold of her and dragged into the cow shed and tried to outrage her modesty when she raised alarm to save herself, the father came and she was rescued.

Learned counsel for the applicant submits that the applicant and the victim were known to each other since they were spotted by the father, therefore report has been made, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the prosecutrix. Considering the degree

of allegation and the fact that charge sheet has been filed, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
