1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 228/2016 registered at P.S. Amanaka, Raipur, Distt. Raipur (C.G) for the offence punishable under Section 379 of IPC.

2. As per the prosecution case, a report was made by complainant Beauty Sinha on 09.10.2016 that the motorcycle no. C.G. 04-LF/3094 which was kept behind the house was stolen and subsequently the said vehicle was recovered from the applicant.

3. Learned counsel for the applicant would submit that the applicant has been falsely implicated and in fact he had gone to Police Station to lodge a report about the missing of mobile. It is further submitted that the charge sheet has been filed and the applicant is in jail since 10.10.2016, therefore, he may be enlarged on bail.

4. Learned State Counsel was directed to verify that whether such report about missing of mobile (Annexure A-2) has been made by the applicant. Learned State Counsel submits that as per the information received, the applicant has not lodged any report and for the first time, the applicant was inculpated while trying to sell the motorcycle.

5. Taking into the nature of conduct and the degree of allegations levelled against the applicant, I am not inclined to release him on bail. Accordingly, this bail application is rejected.
