The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.159/2016 registered in Police Station Manendragarh, District Koriya (C.G.) for offence punishable under sections 457, 380, 411, 413, 34 of IPC (offence under Section 413 has been added later on) 2.

As per the prosecution case, in the intervening night of 7-8th May some theft was committed in the house of Rajesh Mishra and certain ornaments, cash and goods were stolen. Subsequently, the applicant and the other co-accused were arrested and in the memorandum of the father of the applicant, applicant was arrested.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, he is in jail since 17/09/2017 and charge sheet has been filed, no further investigation would be necessary, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case, applicant is in

jail since 17/09/2017 and charge sheet has been filed, no further investigation would be necessary, therefore this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
