Sam Koshy Order On Board 04/10/201 This is the second bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicant who is in jail since 06.12.2017 in connection with Crime No. 449/2017 registered at Police Station - Thana Kotwali Jagdalpur, District Bastar (CG) for the offence punishable under Sections 419, 420, 467, 468, 471, 120-B of IPC. The earlier bail application was rejected by this Court vide order dated 28.06.2018 in MCRC No.3503 of 2018.

Counsel for the applicants submits that the repeat bail application

has been filed pursuant to certain witnesses have been examined and who have either not supported the case of the prosecution or have disproved the case of the prosecution.

State counsel, however, opposing the bail application submits that the complainant Satyawati is yet to be examined and the property was also in the name of the complainant Satyawati which is alleged to have been got sold by the applicants in connivance with other accused persons.

Given the aforesaid contentions and submissions on either side, this Court is of the opinion that no strong case for grant of bail has been made out. Accordingly, the present bail application stands rejected reserving the right of the applicants to revive the same after the complainant Satyawati is examined.
