Hon'ble Shri Justice P. Sam Koshy Order On Board 08.10.2018 The dispute in the present writ petition that has been raised is the inter se seniority between petitioner and respondent no.3. 2.

According to the petitioner, respondent no.3 has been all along junior to the petitioner. However, in the gradation list, the name of respondent no.3 has been shown over and above the petitioner. The petitioner is said to have made repeated representations in this regard to the higher authorities but till date no decision has been taken.

Given the said fact, let the petitioner make a fresh additional representation giving entire details available with him so far as his seniority over and above respondent no.3 is concerned to respondent no.2 within a period of 10 days from the date of receipt of certified copy of this order. Thereafter, respondent no.2 shall take a decision on the representation so filed by the petitioner within a further period of 45 days taking into consideration the entire records so far as the grant of seniority is concerned after due perusal of the service record of the petitioner as also the respondent no.3.

With the aforesaid observation, the writ petition stands disposed of. Certified copy today.
