The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.193/2017 registered in Police Station Manendragarh, District Korea (C.G.) for offence punishable under sections 376, 323, 363, 366, 506 of IPC.

As per the prosecution case, on 12/06/2017 while the prosecutrix was going alongwith her sister and husband to attend the marriage ceremony in the mid way she felt not well and thereafter she stayed back along with her sister near grave yard, at that time the applicant came there dragged the prosecutrix inside the grave yard and committed sexual intercourse and sister of the prosecutrix fled away out of fear. 3.

Learned counsel for the applicant submits that prosecutrix was a consenting party and she was major and medical also do not support the happening of the incident, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the victim and Rannu @ Mithi. Considering their statement, this court is not inclined to release the

applicant on bail.
