Mr. Suryakant Mishra, Panel Lawyer, for the State. This is first bail application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant. As per the prosecution case, on information being received that some one is trying to sell the motorcycle without any valid documents, the police has conducted the raid and thereafter, the present applicant was arrested. Subsequently it was found that the said motorcycle which the applicant was trying to sell was a stolen motorcycle bearing Regn.No.C.G.10-Y/3109 Learned counsel for the applicant submits that the applicant has been falsely implicated and no seizure was made in person from the present applicant, therefore, he may be enlarged on bail.

Per contra learned State Counsel opposes the bail application and submits that one another similar nature of case was registered against the present applicant.

Perused the case diary.
