Shri Somkant Verma, Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 05.10.2018 The challenge in the present writ petition is to the order Annexure P-1 dated 26.09.2018 whereby the services of the petitioner have been transferred from Bilaspur to Korba.

Counsel for the petitioner submits that the petitioner is a Class-III employee working as Assistant Grade-I and that he is to retire on 30.06.2019 i.e. only less than 9 months are left to retire. He submits that at this juncture transferring the petitioner from Bilaspur to Korba would be putting the petitioner and his family to great inconvenience at the fag end of his career.

Given the said fact, let the petitioner make a suitable representation to respondent no.2 within a period of 10 days from today and on such representation being filed by the petitioner, the respondent authorities within a further period of 60 days shall consider the same and also look into the aspect as to whether there was any necessity on the administrative side in transferring the petitioner at this stage of his career when only about 9 months service is left. Till the decision is taken on the representation of the petitioner by the concerned authority, there shall be a stay of the effect and operation of the impugned order so far as the petitioner is concerned. 4.
