The applicant has preferred this bail application under Section 439 of CrPC, as he has been arrested in connection with Crime No.26/2016, registered at Chowki Morga, Police Station Bango, District Korba (C.G.) for the offence punishable under Sections 366, 368, 420, 370, 34 of IPC.

It is alleged that the complainant/victim was suffering with ailment for which she resorted to witchcraft preformed by the present applicant on the first day and thereafter co-accused Keshwar joined the applicant to perform witchcraft. Another co-accused Rajesh also joined the witchcraft on the third occasion and subsequently Rajesh trafficked the victim by abducting her to

Gorakhpur, Allahabad, Agra etc. This Court has rejected the bail application of Nisha, Anil Kumar Gupta, Kailash and Shambhunath Gupta, however, the bail application of Keshwar has been allowed in MCRC No.4172/2016 on 29.07.2016. 3.

Having perused the case diary, it appears, the allegation against the present applicant is more or less similar with the allegation against Keshwar, S/o Ram Tahal, who has been directed to be released on regular bail by this Court in MCRC No.4172/2016. 4.

Accordingly, the present bail application also deserves to be and is hereby allowed. The applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
