Admittedly the civil suit concerning dispute of title over the subject land, which is said to be acquired by the National Highway Authority of India (NHAI), is pending consideration before the jurisdictional civil Court, therefore, the prayer made by the petitioner for stay of the disbursement of the amount of compensation may be moved before the Civil Court in form of prayer under Order 39 Rule 1 & 2 of the CPC.

Accordingly, the writ petition stands disposed of with the liberty as stated supra.
