1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 150/2016 registered at Police Station City Kotwali, Dhamtari, Distt. Dhamtari (C.G) for the offence punishable under Sections 457 & 380/34 IPC.

2. As per the prosecution case, in between 21.04.2016 and 05.05.2016, the applicant entered into the house of one Kishanlal Dewangan along-with other accused and committed theft of different articles and ornaments. Subsequently on the memorandum of other accused the applicant has been inclupated.

3. Learned State Counsel was directed to call for the report from the Probation Officer which was received wherein it is reported that the applicant may be given one chance to join

the mainstream and his behaviour is also reported to be correct.

4. Perused the report of the Probation Officer. Considering the report wherein the recommendations have been made to allow the applicant to join the main stream and the conduct of the applicant is also reported to be correct, I am inclined to release the applicant on bail.

5. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on executing a surety in sum of Rs.25,000/- by the parents/guardian of the applicant. The parents/guardian shall also undertake to produce the applicant before the trial Court as and when directed by the said Court.
