The applicants have preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as they are arrested in connection with crime No.53/2017 registered in Police Station Pandatarai, Dist. Kabirdham for offence punishable under Section 20 (b) (ii) (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The applicants were allegedly found to be in possession of illicit Ganja weighing 4 kgs.

Learned counsel appearing for the State would oppose the bail application.

Considering the facts and circumstances of the case; further considering the fact that the concerned SHO has not reported about the previous criminal antecedents of the applicant of having involved in similar nature of crime; investigation is complete and the charge sheet has already been filed; and also the fact that the applicants are in jail since 17-7-2017, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court.
