The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.45/2016 registered in Police Station Kotwali, Raipur, Distt. Raipur (CG) for offence punishable under sections 294, 323, 324, 327, 506-B/34 of Indian Penal Code. 2.

As per the prosecution case, on 1/03/2016 the applicant along with co-accused went to the house of the Vikram Singh and demanded money for liquor and on having refused, the applicant and co-accused attacked the complainant and assaulted him by way of a sharp weapon on his abdomen. Thereby, offence is committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, no evidence is on record to show that the applicant has assaulted the victim and only on presumption the applicant has been inculpated, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary documents, statement as also memorandum statement of the applicant. At the instance of the applicant

main allegation of assault is on the applicant and on his memorandum weapon was recovered. Considering the allegation against this applicant, this court is not inclined to release the applicant on bail. 6.
