The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.72/2016 registered in Police Station Bodla, Distt.-Kabirdham (CG) for offence punishable under sections 420, 406 r/w section 34 of Indian Penal Code.

As per the prosecution case, a written report was made by one Sriram Markam on 8/02/2014 that the applicant along with other coaccused Vijendranath Pratap Singh came to him and settled for purchase of gram on the higher price which was prevailing in the market. Thereafter, negotiated for purchase. Consequently, goods of total amount of Rs.12,56,285/- was handed over and further sale consideration was not paid back.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case. He submits that complainant has made report to the Chhattisgarh Rajya Anusuchit Janjati Ayog as per Annexure A-4 wherein complaint has been lodged against other coaccused Vijendranath Singh and no whisper was made against the present applicant and entire allegation are civil in nature, charge sheet

has been filed, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement as also statement made to the Chhattisgarh Rajya Anusuchit Janjati Ayog filed as Annexure A-2. Considering the nature of allegation and the report made and also for the fact that charge sheet has been filed, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
