(3) With the consent of both the parties, the matter is heard finally.
(4) The petitioner has preferred the petition under Section 482 of the Code of Criminal Procedure (in short, 'Cr.P.C.') to close opportunity of producing the prosecution witnesses in S.T.No.52/2013 and trial Court may be directed to dispose of case within prescribed period.
(5) Counsel for the petitioner submits that the petitioner is facing trial along with co-accused Prem Kumar Choudhary for the offences punishable under Sections 376, 506, 509 read with 34 of IPC. The case is pending before the trial Court since 04.03.2013.
(6) As per certified copy of order sheet dated 27.05.2019, non bailable warrant has been issued against the co-accused Prem Kumar
Choudhary.
(7) Looking to the above mentioned facts and circumstances, the trial Court is directed to dispose off S.T.No.52/2013 as soon as possible giving the top priority basis. The instant petition is disposed off accordingly. Sd/- (Sharad Kumar Gupta) Judge L/-
