HIGH COURT OF CHHATTISGARH, BILASPUR MCRC No. 7746 of 2016 Jamil Khan S/o Late Jalil Khan Aged About 28 Years R/o Sailendra Apartment Face-2, Mandir Chowk, Jarhabhata, Police Station Civil Line, Tahsil & District Bilaspur, Chhattisgarh ----Applicant
Versus
State Of Chhattisgarh Through: The Police Station Civil Line, District- Bilaspur, Chhattisgarh ---- Respondent For applicant - Shri Ritesh Verma, Advocate. For Respondent/State - Ms. Sunita Jain, PL.
Hon'ble Shri Justice Goutam Bhaduri Order 15/12/2016 1.
The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.367/2016 registered in Police Station Civil Line, Bilaspur for offence punishable under sections 294, 506, 327, 323 of Indian Penal Code.
2.
As per the prosecution case, on 18/06/2016 Tapan Goswami made a report that the applicant came to his apartment, demanded the rent though he was not the owner. Subsequently, when he came out he was caught hold of by the collar and was abused and assaulted. Thereby, offence has been committed.
3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, he was care taker of the apartment, therefore he demanded the rent and false allegations have been attributed, therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail and would submit that as many as four cases are registered against the applicant at different period of time.
5.
Perused the case diary and the documents. Against the applicant
four cases are registered under different sections. Two cases appears to be of the year 2016. One is under Section 107, 116 of Cr.P.C. and another bearing Crime No.253/2016 for offence under Section 294, 506, 323 of IPC whereas other cases are under Sections 452, 147, 148, 149, 427, 323, 324 of IPC. Taking into past antecedents of the applicant as appears he is involved in similar nature of cases, this court is not inclined to release the applicant on bail.
6.
Accordingly, the bail application is dismissed. Sd/- (Goutam Bhaduri) JUDGE gouri
