The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.114/2017 registered in Police Station Nagarnar, Dist. Bastar for offence punishable under Section 20 (b) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3.

The applicant was allegedly found to be in possession of illicit Ganja weighing 5 kgs. whereas co-accused Samyel Anil Kumar Baga was in possession of 4.8 kgs. of illicit Ganja when they were

traveling from Odisha to Jagdalpur in a bus belong to Payal Travels.

Learned counsel appearing for the State would oppose the bail application.

Considering the facts and circumstances of the case; further considering the fact that the concerned SHO has not reported about the previous criminal antecedents of the applicant; charge sheet has already been filed; and also the fact that the applicant is in jail since 24-5-2017, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
