Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 2-111. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.
2. The applicant has been arrested in connection with Crime No. 7/2017 registered in police station Ambikapur, Distt. Surguja (CG) for offence punishable under Section 395, 397, 412, 120-B, 201 of IPC and Section 25 and 27 of the Arms Act.

4. Case diary is not available. Counsel for the applicant produced photocopy of the charge sheet.
5. Prosecution story in brief is that on 4-10-2017, a dacoity happened in Manappuram Gold Loan branch Brahmaroad, Ambikapur and dacoits robbed 12 kg gold, Rs. 1,54,000/- cash, camera etc. On the memorandum of applicant, a light gun, weighing machine, kasoti and suhaga were seized from him. The complicity of the applicant in the offence is that he melted 150 gm gold and committed disappearance of the evidence related to the robbed property.
6. As per photocopy of the arrest memo which is a part of the
charge sheet, there is no criminal antecedent of the applicant.
7. Looking to the above facts and circumstances of the case, application is allowed. It is ordered that if the applicant furnishes one solvent surety for a sum of Rs. 50,000/- along with one personal bond of the like sum to the satisfaction of the trial Court concerned, he be released on bail.
