This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.202/2016, registered at Police Station - Nevai, District - Durg (C.G.) for the offence punishable under Sections 420, 467, 468 & 471/34 of Indian Penal Code. 2.
As per the prosecution case, the applicant had obtained Rs.60,000/- from the complainant Rajesh Kumar for providing job but he is alleged to have given a forged call letter to the complainant and thereby has committed the offence.

Learned counsel for the applicant submits that the applicant has
Page No.2 been falsely implicated. He submits that there are two accused persons; present applicant and co-accused Sunil Kumar and Rs.25,000/- has already been returned to the complainant, therefore, prays that the applicant may be enlarged on bail. 4.
On the other hand, learned counsel for the State opposes the bail application.

Perused the case diary and the documents.

Considering the fact that initially when the job was not granted, Rs.25,000/- was returned and subsequently, some cheque was given, however, the same could not be encashed and also considering the nature of offence committed by the applicant, I am not inclined to release the applicant on bail. 7.
Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
