1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.816/2016, registered at Police Station Ambikapur, District Sarguja (CG) for the offence punishable under Section 20 of the Narcotics Drugs and Psychotropic Substances Act.

3. The applicant and co-accused Ajay Sonwani were found to be possessed of illicit psychotropic substance in form of cough

syrup containing Codeine Phosphate. Total quantity of 195 bottles of cough syrup was recovered in a gunny bag.

4. Admittedly, co-accused Ajay Sonwani has already been released on bail by this Court vide order dated 03.10.2017 passed in MCRC No.1675 of 2017.

5. Considering the entire facts' situation of the case, this Court is inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
