1. First bail application preferred by the applicant was dismissed on merits vide order dated 09.08.2021 passed in MCRC No. 5266 of 2021.

2. The applicant has preferred this second bail application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No.227/2020 registered at Police Station Khamhardih, Raipur, C.G. for the offence punishable under Section 304-B, 34 of Indian Penal Code.

3. After arguing at length, learned counsel for the applicant seeks to withdraw this bail application with liberty to file afresh as and when occasion arises.

4. Accordingly, the bail application is dismissed as withdrawn with the aforesaid liberty.
