This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.09/2016 registered at Police Station- Korandha, Distt. Balrampur-Ramanujganj (C.G.) for the offence punishable under Section 363, 365, 370(1), 370(4), 370(5), 34 of Indian Penal Code.

As per the prosecution case, in the month of August, 2016, it is alleged that the present applicant allured different girls to get them job at Delhi and took them there to provide job. Subsequently, one of the boy came back while other victim girls were working there and on a report made, the recovery of the girls was made; thereby offence has been committed.

Learned counsel for the applicant submits that with the consent of the family members, the boy and girls went to Delhi and they worked there. He further submits that the charge sheet has been

filed, no further investigation is necessary and the applicant is in jail since 26.10.2017; therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Considering the facts & circumstances of the case, nature of allegation and taking into fact that charge sheet has been filed and the applicant who is lady is in jail since 26.10.2017, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for her appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Ashok
