The applicant has preferred this bail application under Section 439 of CrPC, as he has been arrested in connection with Crime No.23/2017, registered at Police Station Dabhra, District JanjgirChampa (C.G.) for the offence punishable under Section 376 of IPC.

The applicant has allegedly committed forcible sexual intercourse with the prosecutrix, aged about 30 years, on promise to marry, and the said relation continued for about 8 years.

Learned State counsel would read over her statement under Section 161 CrPC, whereas learned counsel for the applicant would read over the deposition of the prosecutrix recorded before the trial Court.

Considering the entire facts situation of the case, particularly the deposition of the prosecutrix, this Court is inclined to release the applicant on bail. Accordingly, the bail application is allowed. The applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
