The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.100/2017 registered in Police Station Banki Mongra, Dist. Korba, for offence punishable under Section 420/34 of the Indian Penal Code.

Applicant is driver of the dumper, which was found to be loading coal from the coal mines owned by the SECL and at a nearby place another dumper bearing same registration number was parked, therefore, when information was received both the dumpers were checked and the applicant was arrested.

Learned counsel appearing for the State would oppose the bail application.

Considering the facts and circumstances of the case, further considering the fact that the offences are triable by the JMFC; charge sheet has already been filed; and also considering the fact that there is no previous criminal antecedents of the applicant; and also the fact that applicant is in detention since 20-8-2017, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
