1. Learned counsel for the petitioner would submit that the petitioner has been transferred from Police Station Kapu, Dist Raigarh to City Kotwali Raigarh and is due to retire on 30.06.2022 and therefore the order is liable to be set aside.

2. Learned State counsel opposes the argument.

3. Perused the documents and heard learned counsel for the parties.

4. Be that as it may, considering the facts, it is directed that the petitioner shall be at liberty to make a representation before Respondent No. 2 within a period of 2 weeks from today stating that he is due to retire on 30.06.2022 and Respondent No. 2 is further directed to consider and decide the same strictly in according with law and as per the policy applicable within a further period of 4 weeks from the date of receipt of the copy of the representation.

-25. In the meanwhile, if the petitioner is not relieved, he may not be relieved till the representation is decided.

6. With the aforesaid observation, the petition stands disposed off.
