This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.298/2017, registered at Police Station Basna, District Mahasamund (CG) for the offence punishable under Sections 363, 366, 376 of IPC and Section 6 of the Protection of Children from Sexual Offences Act.

Having gone through the statement of the prosecutrix, it appears she is less than 18 years of age and the applicant induced and committed forcible sexual intercourse with her on promise to marry. 4.

Considering the nature of evidence, the present does not appear to be a fit case to enlarge the applicant on regular bail at this stage. 5.

Accordingly, the bail application is dismissed reserving liberty in favour of the applicant to repeat the prayer after examination of the prosecutrix.
