1. Apprehending arrest in connection with Crime No. 397/2016 registered at Police Station Civil Line, Raipur, Distt. Raipur (C.G) for the offences punishable under Sections 420, 467, 468, 471, 411, 34 of IPC, the applicant has filed this application u/s 438 of the Code of Criminal Procedure.
2. As per the prosecution case, the applicant alongwith other accused on the basis of forged Aadhar Card, electricity bill and forged Cheques of HDFC Bank had taken LED T.V., and further on the basis of forged documents obtained motorcycle TV, Fridge etc.
3. Learned counsel for the applicants would submit that the allegations are attributed to Yogendra and thepresent applicant has not committed any offence and the applicant has been falsely implicated, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the prayer.
5. Perused the case diary documents. It appears that on the basis of forged ID and other documents, the goods were purchased. Further, the charge sheet has been filed wherein the applicant is shown to have been absconded. Taking into such facts and circumstances of the case, I am of the view that it is not a case where the benefit of section 438 Cr.P.C., can be extended.
