Hon'ble Shri Justice P. Sam Koshy Order On Board 10.12.2021

1. The limited prayer that the petitioner seeks, is for an appropriate direction to the respondents No. 4 to 6 to take a decision on the application for demarcation which the petitioner has filed in-respect-of land bearing No. 1096/3 measuring 0.06 hectare in village Ganiyari, Block Takhatpur Tahsil Sakri district Bilaspur.

2. From the proceedings, it also appears that the Additional Tahsildar Ganiyari i.e. the respondent No. 5 has already issued an instruction to the respondent No. 6 for demarcating the property vide order dated 09.06.2021, however there has been no further development, which has led to filing of the present writ petition.

3. Given the aforesaid facts and circumstances of the case, the respondents No. 4 to 6 are hereby directed to ensure that the demarcation proceedings initiated for the aforementioned property be carried out in accordance with law after hearing all the interested parties to the said property at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.
