The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.14/2013 registered in Police Station Ghumka, Rajnandgaon for offence punishable under Sections 409, 465, 467, 468, 471/34 of the Indian Penal Code. 3.

Applicant is allegedly involved in misappropriation/ embezzlement of Gunny Bags. Admittedly, several accused persons have been released on bail in M.Cr.C.Nos.1564, 1568, 682 & 6206 of 2015.

Although the present applicant was absconding for substantial length of time is either arrested or surrendered after finalisation of the trial against co-accused persons, yet considering the fact that the applicant is in detention since 13-10-2017; charge sheet has already been filed against the applicant; and the offences are triable by the JMFC, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
