The applicants have preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as they are arrested in connection with crime No.271/2017 registered in Police Station Baradwar, Dist. Janjgir-Champa for offence punishable under Sections 294, 323, 506 & 458/34 of the Indian Penal Code.

The applicants have wrongfully restrained the injured and caused grievous hurt by means of lathi and iron rod causing two incised wounds over his right forearm and over neck. 4.
Learned counsel appearing for the State would oppose the bail application.

Considering the facts and circumstances of the case, further considering the fact that the offences are triable by the JMFC; charge sheet has already been filed; and also considering the fact that there is no previous criminal antecedents of the applicant; and also the fact that applicants are in detention since 19-10-2017, this Court is inclined to release the applicants on bail. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
