The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of bail as he is in custody since 09.01.2017 in connection with Crime No. 228/2016 registered at Police Station : Jarhagaon, District Mugeli for the offences punishable under Sections 363, 366, 376 IPC and 4 & 6 of Protection of Children from Sexual Offences Act, 2012 (for short the POCSO Act).

Counsel for the applicant submits that he may be permitted to withdraw this application with liberty to renew the prayer for bail after the statements of the parents of the prosecutrix are recorded. The State counsel has no objection to this prayer of counsel for the applicant.

Accordingly, the application is dismissed as withdrawn with liberty as aforesaid.
