The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.375/2016 registered in Police Station Gaurela, District-Bilaspur (CG) for offence punishable under sections 307, 147, 148, 149, 120B & 201, 174 of Indian Penal Code. 2.

As per the prosecution case, on 14/11/2015 a report was lodged by one Vijay Vishwakarma that the injured Anand called him alongwith one Umesh and went to Horri Dojra Forest. When they travelled some distance, at that time, Anand was assaulted by 5 unknown persons and subsequently Vijay Vishwakarma made a report and the applicant was arrested on 16/02/2016 on the memorandum of other accused. 3.

Learned counsel for the applicant submits that similarly placed co-accused has been enlarged on bail on 29/11/2016 vide M.Cr.C. No.7476 of 2016 and the applicant is in jail since 16/02/2016, therefore the applicant may be released on bail.

Learned State counsel do not dispute the fact that similarly placed co-accused has been enlarged on bail on 29/11/2016 vide M.Cr.C. No.7476 of 2016.

Considering the facts and circumstances of the case and also for the fact that similarly placed co-accused has been enlarged on bail on 29/11/2016 vide M.Cr.C. No.7476 of 2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
