1. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 24.10.2017 in connection with Crime No. 268/2017 registered at Police Station Gandai, Civil & Revenue District Rajnandgaon (CG) for the offence punishable under Sections 3, 4 & 5 of the PITA Act.
2. As per the prosecution case, an information was received that certain prostitute business is going on for that some notes were signed and the signed currency was given to the pointer and witnesses, thereafter on 24.10.2017 he contacted one Bishan Bai and offered the money thereafter Bishan Bai along with one Phulbatiya Bai called the girl and part of the amount as was agreed was handed over to them. At that time the police raided and seized the such signed notes and the other persons including the
present applicant, who was involved in the prostitution and being offered as a prostitute.
3. Learned counsel for the applicant submits that the applicant is a worker of a N.G.O., who was working for making awareness of the AIDS, she has been falsely implicated and she is in jail since 24.10.2017, therefore, the applicant may be released on bail.
4. Per contra, learned State counsel opposes the prayer for grant of bail.
5. I have perused the document. Considering the facts that the applicant is a lady and she is in jail since 24.10.2017, no further investigation appears to be necessary and the offence is triable by the JMFC, I am inclined to release the applicant on bail.
6. Accordingly, the application is allowed and the applicant is directed to be released on bail on her executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. She is directed to appear before the trial Court on each and every date given by the said Court.
